Yes. Recreational cannabis is legal in Maine for adults 21 and older. Maine voters legalized adult-use cannabis in 2016, and licensed retail sales began in October 2020. You can legally buy, possess, and consume cannabis within the limits set by Title 28-B of the Maine Revised Statutes, regulated by the Maine Office of Cannabis Policy (OCP). Maine became one of the first states in the Northeast to legalize recreational cannabis. The 2016 ballot measure (Question 1) legalized adult possession and use effective January 2017, and the first licensed adult-use dispensaries opened in October 2020. Today the state has roughly 180 active adult-use retail stores (OCP 2025 annual report).
Legal cannabis in Maine covers three activities for adults 21+:

Maine also has a long-running medical cannabis program (since 1999) governed by Title 22 ch. 558-C, which operates under separate rules and higher possession and grow limits for registered patients and caregivers.
Is Recreational Weed Legal in Maine?
Yes. Recreational—or adult-use—cannabis is legal under Maine law for adults 21 and older, subject to possession, cultivation, consumption, and location restrictions. Adults 21+ with valid government-issued photo identification are eligible to purchase from a licensed adult-use cannabis store.
Retail availability is separate from purchasing eligibility. Municipalities must authorize adult-use retail activity, and an opt-in does not necessarily mean an active store operates there — per the Maine Office of Cannabis Policy, "a municipality's opt-in for a given activity does not imply there are licensees in the municipality who are actively engaging in that activity." Can visitors or tourists purchase adult-use cannabis? Yes. Any adult 21+ with a valid government-issued photo ID may purchase at a licensed Maine dispensary regardless of residency. You do not need a Maine driver's license. However, you cannot transport cannabis across state lines — consume or dispose of it before leaving Maine. Can You Grow Cannabis at Home in Maine?
Yes. Adults 21+ may grow cannabis at home for personal use within these limits:
- Up to 6 mature flowering plants
- Up to 12 immature plants
- Unlimited seedlings
The mature-plant limit was raised from 3 to 6 in 2023 under P.L. 2023, ch. 220 (LD 555). The limits are per person, so a household of two adults can grow 12 mature and 24 immature plants. Plants must be tagged with your name, ID number, and the notation "Personal Adult Use – Title 28-B, Section 1502," and grown in a secure space not visible from a public way. Edibles, Concentrates, and Product Types
All standard cannabis product types — flower, edibles, concentrates, tinctures, and topicals — are legal for adult use in Maine when purchased from a licensed store. Adult-use edibles may contain no more than 10 mg THC per serving and 200 mg THC per package under 28-B M.R.S. §703, subject to the statutory allowable variance. Where Cannabis Is Still Illegal in Maine
Federal land — illegal in Acadia National Park, national forests, wildlife refuges, and federal buildings. Adult-use cannabis remains a Schedule I controlled substance under federal law. In April 2026, the DEA moved FDA-approved cannabis pharmaceuticals and state-licensed medical cannabis products to Schedule III (91 FR 22714), but this limited action does not legalize adult-use cannabis on federal land. The broader rescheduling rulemaking concluded its hearing in July 2026; a final rule is still pending.
Driving impaired — a cannabis OUI carries the same class of penalties as alcohol.
Crossing state lines — transporting cannabis out of Maine is a federal offense, even to another legal state.
